Court judgment in BW: Corona aids do not have to be repaid!
In a groundbreaking judgment, the Administrative Court of Stuttgart decided that two operators of a restaurant and a hairdressing salon from Baden-Württemberg do not have to provide the repayment of corona-related help. The recovery notices of over 10,400 euros and 15,000 euros were declared illegal. The reason for this are misleading formulations in the application documents that the applicants misleaded and made it impossible to recognize that the help were only intended for temporary liquidity bottlenecks.
The judges ruled that unclear information at the expense of the authorities is at the expense of the authorities. This means that the country cannot reclaim the amounts paid out, since the applicants erroneously assumed that it is general aid. Although the judgment fell in September and the decision is not yet final, it could have far -reaching consequences for other affected people who have also received recoors.
