In a pioneering judgment, the Federal Social Court in Kassel decided that the job center must cover double rental costs under certain circumstances. The case concerns a single mother from Bonn, who had to pay more rent due to a delay when moving to a larger apartment than originally planned. Although the job center initially refused to pay costs, the court found that the additional expenses for the accommodation were necessary.
The move of a 54 square meter in large apartment was approved by the job center. The associated moving costs were also financed. However, due to renovation work, the family could not move in as planned and was forced to pay rent for a short period of time in both apartments. The job center did not want to cover the additional costs of 550 euros, since it was classified as "housing costs" and was not granted any prior assurance.
The plaintiff argued that the additional costs are not a matter of housing costs, but rather accommodation costs in accordance with the legal requirements. The court confirmed that, as long as the double rental payment is "unavoidable and specific", the job center must bear these costs. This decision is of great importance for citizens' money recipients who could stuck in similar situations and provides a legal framework that they can rely on.
In addition, the case illustrates that there are often problems with the assumption of costs for moving. Other cases in which JobCenter refused to refuse services have shown that citizen benefit recipients often face the challenge of clearly formulating their claims. This could underline the need that recipients are extensively informed about their rights and the applicable laws.
