Waldbröler stood in court because of the allegation of coercion
Last Monday, a 26-year-old man from Waldbröl was acquitted before the district court. The defendant faced the accusation of coercion after an incident had taken place in the Boxbergkreisel in June of last year. In the indictment, the prosecutor stated that there was an argument about the right of way that took place in the early morning.
The action began when the defendant, who saw his priority, followed another vehicle from Reichshof. He overtook the car and is said to have made the driver stop by braking. Then he left his vehicle and got in touch with the driver by drumming on her car. On the basis of these events, a penalty order of over 30 daily rates and one -month driving ban was issued against him, against which the man objected, which led to the court's hearing.
The accused did not comment in the course of the procedure. The witnesses that were sitting in the other party's vehicle were invited and should identify the accused as a driver. However, while all witnesses called him the driver, there were uncertainties due to the darkness, which made their statements less clear.
In addition, it was to be noted that there had been interactions among the witnesses before the negotiation, who could possibly have influenced their perception. The judge, Christina Knauer, found that the feeling that the accused could have driven was not sufficient to justify a conviction. The case illustrates the challenges that can occur in the evidence in traffic situations, especially if there is a lack of clear evidence.
The judgment, which resulted in the acquisition of the accused, shows the importance of objective evidence in court proceedings. Cases like this often raise questions about the appropriate judicial practice and emphasize the need to respect both the rights of the accused and the victims.
