Two drug dealers in Wiehl condemned: Different punishments for similar acts

District Court Bonn condemns two drug dealers from Oberberg

The Bonn district court decided in a procedure against two men from the Oberberg region. The 27-year-old defendant from Wiehl received a probation penalty of ten months, while his 36-year-old accomplice from Gummersbach had to expect a prison sentence of three and a half years. Both were sentenced to minors due to the sale of narcotics, with both perpetrators having the same customers.

The accused acted independently with marijuana and ecstasy to finance their own substance dependency. However, the younger dealer was punished milder because the amount of drugs was lower and the age difference to the minor customer was not significant.

drug deal: The largest individual quantity was 80 grams of marijuana

In this case, the largest amount that could be determined was given as 80 grams of marijuana. The acts took place between January and April 2020 and the criminal chamber rated the 36-year-old business as two separate deeds, while the 27-year-old was summarized as one. The buyer, a 16-year-old, was also involved in drug trafficking.

The two men got to know each other in 2018 through a common friend. The older defendant already had a prehistory in drug trafficking and was still active despite successful therapy. Immediately after his release from the intelligence enforcement, he continued his illegal activities and made the youngsters his "runner" for drug sales.

The defense of the younger defendant has announced that the judgment does not contest the judgment, while the lawyer of the 36-year-old plans to take legal action, since he believes that his client's deeds should also be considered less difficult. Previously, the indictment had only requested a prison sentence of two and a half years.
