The district and the city of Freising have filed a lawsuit against this provision, which calls on an oral hearing on Tuesday, July 8th, at 9 a.m. at the Administrative Court. The plaintiffs, including the municipality of Berglern, the BUND Nature Conservation and several private individuals, contested the decision of the South Bavaria air, which found that Flughafen München GmbH (FMG) started implementing the planning approval decision on the third runway. The lawsuit is based on the fact that the air office is said to have disregarded fundamental constitutional Standards, especially since the procedural files are considered incomplete. District Administrator Helmut Petz is optimistic and refers to the lower number of flight movements - from 413,000 in 2019 to only 302,000 in 2023. According to Petz, the original need for the third runway is no longer available, and the plaintiffs see a realistic opportunity to stop the project.

The dispute over the legal foundations takes a phrase: On September 30, 2024, the FMG had submitted the air office to confirm the permanent validity of the planning approval decision. This claim is classified as scandalous and illegal, according to Dr. Christine Margraf, deputy state representative of the Bund Naturschutz (BN). The BN also filed a lawsuit to achieve a legal review and cancellation of the so-called "eternity notice".

The discussion about the airport expansion also raises legal questions that go up to the Federal Constitutional Court. There are parallels to previous lawsuits in connection with the expansion of Berlin-Schönefeld Airport. Here it was found that a constitutional complaint was not accepted because the plaintiffs had not contacted the responsible bodies in good time and properly. Similar legal hurdles must now also master the plaintiffs in the Munich area, while they are trying to contest the approvals in question Federal Constitutional Court .
