Strike ban at the Weimar Clinic: Union is in appeal!
The employees of the Sophien and Hufeland Clinic in Weimar have to do without a strike: The Erfurt labor court has decided that the planned warning strike on October 14th is illegal. Union ver.di is faced with an impending fine of up to 250,000 euros if the employees should still put down their work. The court confirmed that church labor law fulfilled the requirements of the Federal Labor Court and that conflicts have to be solved by a binding arbitration process and not through industrial straces.
The Evangelical Church in Central Germany and the Diakonie had sued the strike, but confirmed that conflicts in church institutions should not be addressed via strikes, but by an arbitration process. Ver.di, on the other hand, argued that the waiver of the right to strike does not include an appropriate compensation and that it was difficult for unions to implement their concerns without this pressure. The union has appealed against the judgment, and clarification of the fundamental legal questions is expected for the first half of 2025. Despite the legal dispute, there are no direct consequences for the employees of the Weimar hospital, said Diakonie board member Christoph Stolte, who emphasized that the salaries at the clinic are comparable to other hospitals in Thuringia.
