In Fürstenfeldbruck, the minds are encouraged to have a balcony PV system that was recently installed. Nikolaus Laub, a 72-year-old landlord, is faced with an unexpected conflict. With Laub's originally given, his tenant had installed a photovoltaic system on the balcony. Now leaves were asked by his property management to reduce the device again, which he vehemently rejected.

A few months ago, he openly advertised the idea of assembling a solar system in order to actively contribute to environmental protection. "I was very pleased with the quick implementation," reports Laub. The installation, which adorns the tenant's balcony, was carried out at short notice, but this seems to encounter resistance in the common living situation.

The property management, the general housing and bautreuhand GmbH (AWB) from Olching, argues that the balcony PV system is considered a structural change and therefore requires approval. The allegations, which were also reinforced by the complaint of a neighbor, state that the privacy screen of the balcony underneath is affected by the system. This led to a conflict that leaves had not expected, especially since the topic was deleted at the last owners' meeting based on a new law.

"I thought with the new law, which is supposed to promote the expansion of photovoltaic systems, everything would be fine," says Laub. Despite this hope, the problem remains unresolved. A AWB spokesman confirmed: "An assembly without permission is not permitted in an owner community, this must be decided on an owner meeting."

While the legal doubts about the installation of the PV system are clearly out of the room, the Federal Council is also obliged to finally adopt the new regulation to facilitate such installations. On September 27, this decision is expected, according to which both the law and the consent of the owner community must be clarified.

The search for a solution

Nikolaus Laub is optimistic and hopes for a compromise to maintain the PV system in the sense of everyone involved. "I suggested to change the angle of the PV system," he says. This offer could possibly defuse the conflict with the neighbor. Foliage remains sociable and adheres to the idea of continuing to support the project in the future should everything be in the legal clear line.

According to Ulrike Kirchhoff, the chairman of "House and Grund Bavaria", ownership should already grant approval before the legal changes apply. "After the adoption, it will be difficult for the community of owners to defend itself against the installation," she explains. This means that approval makes sense.

For the experienced landlord, illegal dismantling of the balcony PV system is not a practical option. "Removing the system and re -mounting it later would be very impractical," believes Laub. He is ready to observe the process and waits for how the upcoming decisions of the political bodies will end. Once again, such developments show how important a clear legal regulation is in the area of renewable energies in Germany.
