Rental price brake by 2028: What does that mean for Berlin?
Federal Minister of Justice Marco Buschmann (FDP) has submitted a draft to extend the rental price brake by the end of 2028, which is now going into the departmental work within the traffic light government. This step follows the agreement in the coalition agreement, which provides for an expansion by 2029. The rental price brake is currently valid by the end of 2025 and is intended to ensure that rents for new rental contracts are at most ten percent above the local comparative rent. While the application of the regulation is decided by the respective state governments, the new draft plans to provide higher demands on the justification to withstand constitutional control.
At the same time, the government has brought a further draft to the discussion of the communication data for investigative purposes. This regulation provides for a so-called "quick-freeze process", which, however, does not include data retention. Data may only be saved if there is suspicion of serious crimes.
