OLG Hamm: Hyaluron advertising with before and after images prohibited!

The Higher Regional Court Hamm has decided: Advertising with before and after images for smoothing wrinkles with hyaluronic acid is prohibited! In a judgment published on October 8, the court found that the injection of Hyaluron is considered an operational intervention and thus falls under the remedial advertising law. A Recklinghausen company had used such pictures on its website and on social media, which the Consumer Center North Rhine-Westphalia classified and successfully sued.

The judges emphasized that the advertising ban serves to protect consumers from health risks associated with cosmetic interventions. The company defended itself by arguing that there was no operational or plastic surgery. The OLG saw it differently and issued the ban, but has a revision at the Federal Court of Justice (BGH).
