BAföG judgment: Federal Constitutional Court limits the students' claims!
Karlsruhe, Deutschland - The Federal Constitutional Court in Karlsruhe has decided: Students are not constitutional law for higher BAföG services. The court made it clear that the right to a decent subsistence level cannot be derived from state support for the study. This means that the state is not obliged to grant higher BAföG rates, even if this could make studying impossible for many. The current BAföG requirement is therefore still below the basic requirements of other state services, which causes massive criticism.
The decision follows a lawsuit by a master student who saw an increase in the bathing base flat rate for the period from 2014 to 2015 as unconstitutional. The court rejected this and emphasized that the responsibility for BAföG funding was in the parliament. Educational experts and student representatives are now calling for urgent reforms to adapt the BAföG sets to the increasing cost of living.
