Ludwigshafen in the daycare center: court judges claims for damages
A court has decided that municipalities do not automatically have to pay for the costs of alternative childcare if they cannot provide a daycare center. In the case of a mother from Ludwigshafen, who was waiting for a place for her child, the Frankenthal district court dismissed the lawsuit. The parents had applied for a place in May 2020, but only received a promise for September 2023 in April 2023. The court found that the parents first had to exhaust all legal options for enforcing their claim to a daycare center before they can request compensation.
In Ludwigshafen, 3120 daycare places are currently missing, which leads to an acute childcare emergency. Over 3000 places were vacant last year, which is the highest deficit in Rhineland-Palatinate. The city administration predicts a need for 8538 places for the day of 2024/25, while only 7182 are available. The current judgment is being pursued by many affected parents, as it could have an impact on future complaints and the city's financial responsibility.
