Driving license is in danger: Court rules out the request for hardship!

A driver who works as a pharmaceutical officer has sued the immediate withdrawal of his driver's license in front of the Bavarian Administrative Court. This had become necessary due to eight points in the driving suitability register, which is mandatory in accordance with the applicable rules. The man argued that the loss of his driver's license would endanger his professional existence and applied for a suspensive effect in order not to have to give up his driver's license immediately. However, the court rejected the request for hardship and found that the withdrawal of the driver's license is inevitable for frequent drivers despite the associated difficulties.

rules in the driving suitability register

According to the provisions in the driving suitability register, eight points lead to the immediate loss of the driver's license. Traffic offenses such as speed overruns or alcohol at the wheel can lead to an increase in the score. The regulations stipulate that professional drivers cannot automatically benefit from hardship control, which means that withdrawal of the driving license can be a significant professional burden for them.

In addition, the Kraftfahrt-tundeamt Transport violations are recorded. Violations are evaluated according to their severity in points that can be deleted according to certain deadlines. Drivers have the option of viewing their current score and taking measures to act legally safely in road traffic.
