In Meßkirch, the construction of a refugee accommodation is progressing, despite existing concerns. The first containers have already been built on the site, which signals the final progress of the project. Dominic Warken, the head of the Building Law Office in Markdorf and himself residents, comments on the doubts that exist with residents regarding the legality of the building permit. In a letter to the Tübingen regional council, he pointed out his petition that has been running since April, which he has not yet received any feedback.
In its petition, Warken asks at the district office whether enough measures were taken to guarantee healthy living conditions and take into account the necessary consideration. His concerns relate to the proximity of the refugee accommodation to an industrial company, the LAZ machine and apparatus construction. This company produces only a few meters from the planned accommodation and could therefore cause a significant disorder due to noise.
Consider noise pollution
Warken expresses his doubts about the choice of location: "The location selection is critical and legally questionable". The district office, on the other hand, rejected these objections. According to press spokesman Sebastian Korinth, the legislator has introduced special regulations in the course of the refugee crisis that allow refugee accommodation in commercial and temporally in industrial areas. In addition, it was not necessary to make sound measurements because there are no noise complaints from residents.
Warken has a different view. In his opinion, even without complaints, the requirements for healthy living conditions would not be sufficiently met. The legal provisions require that the noise level must not exceed 35 dB (a) and 25 dB (a) at night during the day. He doubts that the containers meet these requirements, which raises the need for noise protection measures in the accommodations.
Although WARKE doubts about the legal admissibility of refugee accommodation in Meßkirch and has submitted a specialist supervisory complaint, he is aware that his petition will probably not be able to stop building the container village. He has already approved an extension of a refugee accommodation in Bermatingen and has no prejudices against the settlement of such facilities in the region. For him, the focus is on the technical point of view, which is why it insists on receiving information about the approval process.
While Warken is waiting for an answer, the construction work is progressing, and the first refugees are to move into accommodation in September. The situation reflects a broader discussion about the challenges and legal framework that goes hand in hand with the establishment of refugee accommodation, and leaves questions about the balance between urgency and legal conformity.
