Rapid escape of a 15-year-old: scooter driver injured during police check!

A strange incident caused a stir in Meckenheim on Thursday evening. In Eichengasse, a police patrol noticed a motor scooter that was occupied by two young people. During the check it turned out that the driver apparently had no reason to calm down: the scooter was driving at a significantly excessive speed and when the officers wanted to stop the duo, the 15-year-old driver, a teenager from Haßloch, chose to escape along field and farm roads. As rheinpfalz.de reports, his escape speed sometimes reached an impressive 80 km/h.

But the exciting race soon ended: At the entrance to Wachenheim, another patrol car stood in the way. The driver desperately tried to escape along the sidewalk, stumbling and colliding with a police car before ultimately crashing. Fortunately, the 15-year-old was only slightly injured, while his passenger was uninjured. During the arrest, officers discovered that the scooter was uninsured and had been tampered with. He was able to accelerate to over 120 km/h - an absolute speed limit that represents an enormous risk not only for the driver but also for other road users.

Consequences of a police stop

The police promptly clarified what happened. In Germany, it is a misdemeanor to fail to comply with a police order to stop, as the catalog of fines from bussgeldkatalog.org describes in detail. A driver who ignores the requirement to stop must expect a fine of 70 euros and one point in Flensburg. This can have serious consequences, especially for novice drivers during their probationary period.

Although the 15-year-old's escape did not involve violence against officers, in many cases like this, an escape is still considered a serious violation. The Federal Court ruling (ref.: 2 StR 204/14) made it clear that violence must be directed directly against a public official in order to be considered resistance. However, this interpretation does not exclude the possibility that the driver's irresponsible behavior could have serious legal consequences.

Penalties for escaping

Escape from the police can be viewed as a motor vehicle race in accordance with Section 315d Paragraph 1 No. 3 StGB, as the lawyer platform anwalt.de emphasizes. This can result in prison sentences of up to two years or high fines. The constitutionality of this regulation was only recently confirmed by the Federal Constitutional Court.

In the case of the 15-year-old scooter rider, this could have far-reaching consequences for his future. The police not only confiscated the scooter, but now also have to take legal action against the teenager. Defending yourself in such cases often becomes difficult, especially when you consider that escaping from the police endangers not only your own life, but also that of bystanders.

The incident in Meckenheim is a striking example of how quickly a seemingly harmless act of riding a scooter can become a serious legal problem. In such situations, it is always advisable to follow police instructions and keep a cool head.
