Development dispute brakes expansion of the Maxlrainer Alm in Hausham

A dramatic turn for the upper Maxlrainer Alm! The building application by Matthias Schmidlin, the owner of the mountain hut, was rejected by the district office. A setback for Schmidlin who has been working on his dream for over five years to modernize the Alm. The development of its construction plans remains an unsolved problem, and that ensures plenty of conversation in the region!

The upper Maxlrainer Alm, located above the popular Spitzingsee and below the majestic Taubenstein, attract many hikers. Despite its almost inconspicuous importance compared to the prominent Forsthaus Valepp, the mountain hut is a constant attraction. But the current construction project that includes the expansion and modernization of the ALM has stalled through bureaucratic hurdles.

official rejection: lack of development!

The unexpected resistance came from the district office, which refused approval for the planned changes due to a lack of development. "The client was not able to demonstrate the secure development of the project in the procedure, but this is a compelling approval requirement," said the clear announcement of the authority. Schmidlin, a former manager in the aerospace, is now faced with long queues and unfulfilled dreams.

A crucial detail is missing: A dedicated and secure path to the Alm, which would be necessary for the construction phase, does not exist. But Schmidlin did not prevent that from speaking of promising discussions with the adjacent landowners in the past.

struggle for the development: who is right?

However,

Schmidlin and his lawyers are optimistic that the development is definitely given, based on documents from the 70s and 80s. When asked how things are going on now, Schmidlin only replies diffuse: "Either an agreement, or someone else has to judge that". And that could possibly be the administrative court.

The neighbors, on the other hand, like Alexander von Schoeler from the property company Wallenburger Alm, seem to have different views. They report on legal disputes and the dispute in front of a property. However, Schmidlin has not commented on a comparative proposal and betrayed the time for the project.

The targeted goal is not to be realized easily: Instead of the 60 beds so far, 69 beds, four personal rooms and one operating manager should be set up on the Alm. A project that the neighbors only want to accept with resistance. However, the district office has made it clear that the questions about the expansion are also irrelevant.

How will the story go on? Schmidlin remains optimistic and seeks to talk to the district office. However, until a solution occurs, the upper Maxlrainer Alm remains on her existing splendor. The number of guests is right, but the construction work? They are on the brink!
