changes in road traffic law

The legal foundations for assessing drug trips have recently changed. Since April 1, 2024, the possession and consumption of cannabis has been partially legalized. A new THC limit of 3.5 nanograms per milliliter of blood was proposed and came into force on August 16, 2024. According to this regulation, an administrative offense procedure for values of 3.5 ng/ml or more THC in the blood is possible, which is a significant change with the previous regulation that did not provide for limit values.

In drug drives, fines of up to 1,500 euros in negligence and up to 3,000 euros in the event of intent are provided as punishments. In addition, driving bans on one month for the first offenders and three months for repeat offenders threaten. The mixed consumption of cannabis and alcohol in particular is punished with increased fines of up to 5,000 euros. Announcers are generally excluded from any consumption of cannabis or alcohol, while there is a medication clause for medically prescribed cannabis consumption.

The changes in the Road Act became necessary to increase traffic safety and to clarify the legal framework for dealing with drugs in road traffic. For the period before the reform, the offenses are subject to the old regulations.
