In a sad turn for the Bavarian economy, DEFACTO GmbH from Erlangen has filed for bankruptcy. The company had been active for 36 years and specialized in customer-centric business models. Around 150 employees are affected by this development. Fortunately, their wages and salaries are secured through insolvency money until the end of September, which provides some planning security while the next steps have to be decided. Mercury reports that the insolvency was caused by sudden declines in sales resulting from the postponement and cancellation of customer orders.

Insolvency administrator Volker Böhm has already announced that he is aiming for a sustainable restructuring of the company in order to preserve as many jobs as possible. The first discussions with potential investors took place before the bankruptcy filing, which gives hope for the future. Despite the difficulties, existing orders and projects are continuing to be processed, which shows that not all is lost.

A look at the insolvency situation in Bavaria

The situation of DEFACTO GmbH is part of a larger trend: In 2024, there was a sharp increase in corporate insolvencies in Bavaria by 18.5 percent, which amounts to a total of 2,995 proceedings. The Bayerischer Rundfunk informs that The retail and vehicle maintenance sectors are particularly affected, with 468 cases registered in the retail sector and 463 in the construction sector. Meanwhile, the real estate and housing sector is doing well with 276 insolvency proceedings, almost twice as many as in the previous year, but still surpasses the hospitality industry with 262 proceedings.

The figures show that insolvencies in Bavaria have risen sharply since 2022 - a trend that can also be clearly felt in the first half of 2024. A total of 6,477 insolvency proceedings were counted between January and June 2024, an increase of 11.9 percent compared to the previous year. The statistics agency points out that 1,444 of these proceedings involved corporate insolvencies, which is the highest level since 2015.

Not only companies are particularly affected, but also many employees. A total of 16,899 employees are affected by bankruptcies, which is almost twice as many as in the previous year. Manufacturing, health and social care, and retail are cited as the most affected areas. Insolvencies are developing particularly dynamically in the construction and real estate sectors, which is why it is time to take a closer look and develop possible strategies for action.
