Noise discussion in Herrsching: Residents fight against restaurateurs!

August brings a few more wonderful days in Herrsching am Ammersee, which attract residents and restaurants alike. In this atmosphere, however, the “Kiez” restaurant in particular causes excited discussions. Residents complain about the noise emitted by guests and musicians, while the operator, Fritz Frömming, a passionate innkeeper, struggles to keep his business open. Frömming has been running the “Kiez” for two and a half years and offers a varied spectrum: breakfast, lunch, snacks and cocktails. However, in order to extend the night's silence, he is planning an online petition that would allow opening hours until midnight on Friday and Saturday and until 11 p.m. on Sunday to Thursday. So far, 270 supporters have registered for his initiative, reports South German newspaper.

But the push for longer opening times is under a dark cloud: the Starnberg district office has already issued a warning due to noise complaints because the opening times have been exceeded. A directly affected resident makes it clear that he has not called the police and is interested in an amicable solution. For him it is important that people work together instead of fighting against each other.

Legal situation and neighbor rights

The situation shows how complex the balance between restaurants and residents is. Catering businesses are bound to numerous laws and permits. Among other things, they have to comply with hygiene regulations and corresponding liquor licenses. In the event of noise pollution, residents are well protected by neighboring law, as well Lawyer Kotz explained. Complaints about noise from restaurants are a common problem that concerns many neighbors and, under certain circumstances, can result in legal action.

But it's not just noise that affects the neighbors. Odor nuisances from kitchen operations can also lead to conflicts, although they are generally less problematic. The Lots of group emphasizes that although courts are aware of the nuisance caused by odors, commercial kitchen operations are often not considered major nuisances.

The importance of neighborly relationships

In a conversation with Volker Mergen, the operator of the “Bavarian Brandung” kiosk, it becomes clear that good contact with the neighborhood is essential in the catering industry. Mergen is well disposed towards Frömming, but at the same time he emphasizes the need to maintain a good relationship with the residents. His kiosk will close at 7 p.m. on Sundays and in the future also on Mondays - a conscious decision to promote acceptance in the neighborhood.

The dilemma between gastronomic freedom and the right to peace and quiet continues to be a challenge. How will the situation in the “neighborhood” develop? With the petition in the pipeline, it remains to be seen whether it will lead to a positive balance between the interests of the operators and residents. Until then, the conversation remains the top priority for everyone involved: after all, a harmonious neighborhood is the key to a lively but also quiet rulership.
