Father sentenced to 2 years in prison: abuse of his daughter discovered!
A serious case has shocked the city of Weiden: A 49-year-old father was sentenced to 2 years and 3 months in prison by the Weiden district court after he was accused of sexually abusing his 13-year-old daughter. Presiding judge Peter Werner noted during the trial that there was intimate contact that was probably consensual. This turned the original charge of aggravated sexual abuse into simple abuse. An incriminating WhatsApp chat between father and daughter played a decisive role in the discovery of the crime.
In the chat, the girl said: "When I come back, we'll have sex." The father replied: “Sure.” The public prosecutor and judge attach great importance to this evidence. The foster mother was able to discover the chat and then informed the relevant authorities, which ultimately led to criminal prosecution. “The chat is strong evidence,” emphasized prosecutor Sofie Huber during the trial.
Serious accusations and emotional pressure
The girl has lived in a foster family since she was one year old after being taken into care in 2014 due to injuries. The situation was emotionally overwhelming for the 13-year-old; she no longer wanted to testify in court and seemed burdened. A report said defense attorneys criticized the girl's interrogations as suggestive. It should be noted that the girl's mother had been known to the youth welfare office since 2001 and the girl has a total of three older half-siblings.
The defendant, who has been in custody since January 2025, is having difficulty finding stable employment. Most recently he worked as a newspaper delivery boy and lived on citizen's money. During the trial he said: “I’m just sorry for everything.” His wife, on the other hand, was relieved about the verdict and would have preferred to take him home immediately.
Legal framework
The laws that exist in Germany to protect children and young people from sexual violence are complex and aim to prevent acts in advance. “International treaties and national laws are intended to protect children and young people from sexual violence,” explains the Federal Commissioner for Crime Prevention. In the family context, special regulations apply that aim to ensure the well-being of the child.
In this case, the question of compensation also arises. Those affected can assert claims for compensation, be it under civil law directly from the perpetrator or through the state's social compensation law. The focus is on protecting the rights of children and protecting them from further attacks.
Cases like these show us once again how important it is to protect and support children and young people. The case of the Weiden father is a terrible example of what can happen in families and highlights the need to be vigilant and act.
