Already in January, the Fifth Large Criminal Chamber of the Oldenburg Regional Court decided that the man's detention was essential to protect the general public. The accused suffers from a psychiatric illness and was confronted with a total of eight criminal offenses.

The threats the man made are particularly alarming. He insulted an employee of the Diakonie's day stay in Oldenburg with sentences like “I'll stab her from behind” and “I'll kill you all”. Probation officers also had to fear his aggressive behavior, as threatening statements were also made against them. Dangerous situations arose both at the station forecourt and at Sandfurter Weg in which the defendant repeatedly threatened other people. A homeless man recounts a particularly disturbing incident in which the suspect described in detail how he wanted to kill a woman and seemed to enjoy the thought.

Court decision and psychiatric expertise

During the proceedings, the court heard a psychiatric expert who came to the conclusion that the 35-year-old man had a high probability of committing further serious crimes. This assessment was crucial in justifying his permanent placement. The man also violated instructions from the supervisory authority and broke off contact with the probation service. The court therefore saw no other option than to place him in a psychiatric hospital in order to protect society from possible acts of violence.

The judgment of the Federal Court of Justice, which now confirms the existing decision of the regional court, highlights the urgency of this step. It concerns a man whose past behavior and statements carry the potential for serious danger. The decision suggests that this is about much more than just sanctioning a perpetrator - it is about protecting human lives.
