This not only means that Heinlein and his tenants cannot deduct the additional costs from the tax office, but also that they cannot count on any clear planning for the future. An informal request for an extension of the deadline for billing was simply rejected by the tax office. It seems as if this situation can no longer be saved.

Difficulty communicating and frustration

The property management's communication policy leaves a lot to be desired. Heinlein tried several times to get clarity, but his requests were simply ignored - two registered letters remained unanswered. Only a letter from January 2025 vaguely announced that the annual accounts for 2023 were being prepared. Confusion and frustration are inevitable.

Another problem exacerbates the situation: there has been no owners' meeting since 2023, which has led to poor networking among the owners. Many of them don't know what others are thinking or planning. Rudolf Stürzer from the owners' association Haus & Grund explains that a business plan must be drawn up annually by the manager - which is obviously not the case here.

About the legal options

According to the Federal Court of Justice, the annual statement is due within three to six months after the end of the financial year. The economic plan for 2024 should have been available by June 30, 2025 at the latest, but the affected owners are still left without clear information. Stürzer points out that in theory owners would have the option of suing the property management company for damages, which is probably worth considering for many given the circumstances.

One reason for the delays on the part of the property management could be the recruitment of personnel after the corona pandemic, as the management itself states. But that is little consolation for the affected apartment owners. Ultimately, the situation remains tense until it is finally clarified. After ten days, Heinlein finally received the annual statement, but the frustration still remains great. What could have been avoided with timely billing.
