The owner of the damaged vehicle, a shopkeeper, filed a complaint after taking a photo of the taxi's license plate.

But what did the case actually look like? Mustafa's alibi was confirmed by checking his taxi company's roster - at the time of the crime he was in Ingolstadt, far away from the crime scene in Munich. His physical difference from the actual perpetrator - Mustafa N. is almost 20 cm shorter - also turned out to be a decisive factor during the trial. His defense attorney, Albert Cermak, sharply criticized the police's inadequate investigative work. In his statement to the court, the injured party even expressed that the perpetrator must have “shrunk,” which raised fatal doubts about his statement.

Although the district court ultimately discontinued the proceedings against Mustafa N., the case is not without consequences. The taxi driver has given up his professional existence and wants to reorient himself. The shop owner, on the other hand, continues to demand compensation of EUR 4,700 from Mustafa N., a circumstance that further illustrates the impact of the miscarriage of justice.

But what exactly is a miscarriage of justice? According to the website Wikipedia it is a flaw within the justice system that often arises from unintentional misconceptions or procedural errors. In many cases, innocently convicted people are also referred to as victims of justice. A disturbing example are the figures that show that around 90 reopenings of over 800,000 final criminal cases take place in Germany every year. In Austria, compensation of EUR 20-50 per day is granted for proven miscarriages of justice - certainly no consolation for those affected, who will have to suffer the consequences for the rest of their lives.

The tragedy behind Mustafa N.'s case exemplifies the weaknesses of the justice system. The shock of the false accusation and the financial demands of the injured party counteract a deep-seated mistrust in the justice system. According to a survey, only 30% of the population have complete trust in the judiciary. The criticism of the German judiciary cannot be dismissed out of hand - a lack of self-criticism and overwhelmed judges are just a few points that come up again and again.

The case of Mustafa N. is therefore not just an individual drama, but a wake-up call to society to examine the legal system for its errors and to face the challenges of miscarriages of justice.
