The summer holidays have already begun in many federal states and numerous travelers have set out to enjoy the first holiday of the year to the fullest. A striking example is the case of a package trip to northern Italy that cost around 2,400 euros for two people last year. Due to severe storms with landslides and contaminated beaches, the plaintiff was forced to cancel his trip. The court decided that free cancellation was permissible due to “unavoidable, exceptional circumstances” (judgment of May 16, 2025, case number 2-24 S 75/24). Accidents and defects on vacation
Equally revealing is the case of a “bike and sports mix week” in Flachau, which the plaintiff booked for around 1,400 euros. The traveler suffered torn ligaments after falling on a rerouted tour. The court saw a lack of travel here and sentenced those responsible to pay over 6,000 euros (judgment of June 26, 2025, case number 2-24 O 55/22). The case also shows how important the guides' duty of care and welfare is.
Another interesting decision involved five travelers who were turned away at the airline gate more than 45 minutes before departure, even though boarding had not yet been completed. The court decided that the airline still had an obligation to take along (judgment of June 5, 2025, case number 2-24 S 93/24). This underlines how essential it is that travelers are aware of their rights and demand them.
Flight cancellations and compensation
A particularly drastic case concerns a family who booked a package trip to Fuerteventura for around 4,700 euros. On the day of departure it turned out that the flight had been canceled, but the family was not informed of a new departure. The court ruled that the family was entitled to compensation for the lost vacation time (LG decided that 50% of the pro-rata travel price was to be paid). Such decisions show that travelers are not left alone when problems arise.
The Frankfurt rulings during the summer holidays are a good indication that travelers should be clear about their requirements. This is the only way travel deficiencies can be dealt with quickly and efficiently.
