Although the transfer of responsibilities does not have any impact on existing file numbers, those who need clarification can address the changes directly via the responsible contact points of the tax offices.
The new state property tax law
The focus of this restructuring is also the new Hessian Property Tax Act (HGrStG). This was issued on December 15, 2021 and is considered constitutional. The Federal Constitutional Court had previously ruled that the old regulations on uniform assessment were unconstitutional. A property owner had even filed a lawsuit against the tax office's new property tax assessment notice, but the Hessian Finance Court decided that everything was in order and dismissed the lawsuit PwC reported.
With this new law, the property tax base is determined based on specific factors, which is a relief for many owners. The distinction between different types of property – be it a vacant lot or a residential building – is also considered necessary.
