Court ruling: Vaccination lawsuits after Corona unsuccessful in Hesse!
In a groundbreaking decision on July 11, 2025, the Hessian State Social Court decided two appeals regarding benefits after corona vaccinations. Both procedures were rejected, which is particularly important for the people affected from Frankfurt and the Waldeck-Frankenberg district. Like that Medical Journal reported, the court found that there was no sufficiently probable causal connection between the vaccination and the plaintiffs' health problems. This further burdens the legal basis for compensation claims resulting from vaccine damage.
The situation became more detailed in the two cases examined: A 76-year-old man from Frankfurt had filed a lawsuit, which was, however, rejected. In another case involving a 51-year-old from Waldeck-Frankenberg, the lower court upheld the lawsuit, but the state pension office appealed. The State Social Court rejected the claim to benefits in both cases and did not allow an appeal. The case numbers are L 1 VE 24/24 and L1 VE 35/24, as are the Augsburger Allgemeine holds on.
Causality complex case
The ruling sheds light on the legal challenges surrounding compensation claims based on COVID-19 vaccinations. As in the context of one Webinars As was noted, the legal structure surrounding possible vaccine damage is not a simple issue. The court made it clear that proof of probabilities is necessary to establish a claim.
The high number of vaccinations carried out suggests that the issue will be dealt with more intensively in the future by supply administration and social justice systems. Discussions about long-term post-Covid-like conditions known as “post-vac syndrome” will also increase. The complexity of the causality question is considered one of the greatest challenges in future proceedings.
A digital information event will be offered on April 10, 2025 for all those who would like to gain a deeper understanding of legal issues surrounding vaccine damage. Among other things, the legal basis for vaccine damage is discussed here, and specialist speakers such as Dr. Christian Mecke and PD Dr. Bernhard Kleiser provide insights into the assessment of vaccine damage in connection with Sars-Cov-2 vaccines.
Further developments in this area remain exciting, and the courts will continue to be required to make clear judgments and offer those affected a certain degree of security in the future.
