Dangerous traffic madness: truck driver intentionally slows down transporter!
What was going on on the A92 near Altdorf? A 50-year-old truck driver from the Kelheim district caused a stir on Wednesday around 5:20 p.m. when he caused a dangerous rear-end collision. The trucker was traveling in the right lane towards Deggendorf, while a 64-year-old van driver from the Amberg area was speeding in the left lane at around 120 km/h in order to overtake.
Suddenly the truck driver moved into the fast lane for no apparent reason, apparently to slow down the sprinter. In a shocking statement to police, he revealed he "hates" vans and is annoyed by the way they drive because they overtake him too closely. The transporter driver had no chance to brake in time and crashed into the truck.
Good luck in misfortune
Fortunately, the impact did not result in any injuries, but the material damage amounted to around 1,100 euros. The police immediately opened an investigation against the truck driver, and for a good reason. There is a dangerous interference with road traffic, which is regulated in Section 315b of the Criminal Code. This regulation penalizes, among other things, intentional actions that could endanger road safety.
The truck driver could face a prison sentence of up to five years or a fine. According to § 315b StGB, anyone who:
- Anlagen oder Fahrzeuge zerstört, beschädigt oder beseitigt,
- Hindernisse bereitet,
- einen ähnlichen, gefährlichen Eingriff vornimmt.
The legal consequences
In the current case, intentionally braking another vehicle on the highway is a clear case for the prosecution. Such an incident not only violates the trust of road users, but also endangers the life and limb of other road users. To do this, an abstract danger to road safety must be created, which manifests itself in a concrete danger. Behavior that is not only considered less than responsible could also end in the worst possible way.
The legal provisions regarding dangerous interference in road traffic have a long history. The regulation was introduced as early as 1953 to increase road safety. Section 315a of the Criminal Code punished behavior that violates traffic regulations, while the provisions of Section 315b of the Criminal Code focus on the behavior of those outside the traffic. These important legal standards serve to protect all road users and are an expression of how seriously the dangers in road traffic must be taken. Thanks to this legal framework, more such incidents can be prevented.
In times when driving and road traffic are becoming increasingly complex, it is crucial to keep an eye on responsibility. The truck driver's behavior is a vivid example of how easily dangerous situations can arise and how important it is that every road user acts with caution.
