There's a lot going on in the tranquil community in the Dachau hinterland: a 44-year-old man is on trial because he is said to have violated regulations when handling asbestos sheets on his property. The case grew out of a neighborhood dispute that began three years ago when the defendant moved into his semi-detached house. His neighbor, 43 years old and initially willing to help, quickly turned into a bitter opponent.
The argument escalated after the defendant put up a fence and possibly crossed the property line. This led to a heated exchange in which the neighbor threw the foundation stones of the fence back onto the neighboring property. The disputes resulted in numerous lawsuits, reports and police operations; the police have already been there 20 times. Lawsuits for injunctive relief and damages also flourished, and violence protection proceedings were initiated. On top of that, the neighbor's son was reported for threats.
Improper asbestos disposal
The defendant is accused of improperly cleaning and possibly disposing of asbestos sheets. This could have consequences because improper handling of asbestos can result in several criminal offenses. According to legal requirements regulated in the Criminal Code (§ 326 StGB), the unauthorized disposal of hazardous waste is a serious criminal offense. This also includes the improper packaging and disposal of asbestos, which poses health risks for the environment and local residents.
The neighbor claims to have pointed out the dangers of asbestos sheets to the defendant several times. An expert will examine both properties for asbestos residue in the near future. District judge Stefan Lorenz has already made it clear that a conviction of the defendant for negligence cannot be ruled out. This could potentially lead to a fine of up to 3,000 euros - a penalty order that the defendant had already received in October 2024.
