Fire station blocked: dispute over fence escalates in Wolfersdorf!
An explosive dispute is occupying the community of Wolfersdorf, with the conflict over a metal fence that blocks access to the fire station now heating up tempers. The new owner of the adjacent Raiffeisen warehouse, Matthias Denk, built the fence and thereby significantly restricted the fire department's ability to operate. The local emergency services now have to drive around the fence, which, according to district fire officer Manfred Danner, is classified as quite dangerous. The urgency of the situation is also underlined by Mayor Anita Wölfle, who, together with Lukas Schütt, the head of the administrative community, is looking for solutions to keep the fire department access clear. Merkur reports that the ownership structure around the fire station has been unclear since the 1970s, which was not adequately regulated during the construction work.
The situation became particularly explosive during the sales negotiations for the warehouse in 2024. It turned out that part of the fire department access was not owned by the municipality but rather privately. A lease payment of 7,200 euros, which Denk demanded, was rejected by the municipality. Their counter-offer to purchase just 15 square meters of the required property was met with incomprehension. Denk was adamant and described the offer as unacceptable. This messy situation has now led to lawyers being called in, and both sides have already had a local meeting with the fire department and the district office.
Legal situation and possible consequences
While the community points out the dangerous situation by writing to Denk, the other side emphasizes that the fire brigade's operations could remain unproblematic. This raises not only legal questions, but also questions about community safety. A possible legal dispute is on the horizon, with both sides relying on possible court decisions if there is no agreement. This conflict could therefore drag on for a long time and affect citizens' sense of security.
Interestingly, the topic of fire department access also generally involves many legal issues. As the Ask a Lawyer website notes, it is the property owner's responsibility to ensure that fire exits remain clear at all times. In such a case, the landlord could be held liable if a fire or damage occurs. Tenants cannot simply have it towed on their own and should instead inform the public order office.
Protection through fire department access
The regulations regarding fire department access are also anchored in case law in many respects. The decision of the Higher Administrative Court of Bremen determined that the building regulations regarding fire service access are not protective of neighbors CBH reported. This means that neighbors have no direct right to take action against violations if they do not prevent fire from spreading to other properties. The fire department access therefore remains a central element in fire protection, with the protection of the general public always being the priority.
There remains hope for a good solution for everyone involved, because no one wants the fire department to be stuck in a traffic jam in an emergency. What happens next remains to be seen - the dispute over the fence in Wolfersdorf clearly shows how important it is to clearly regulate such issues.
