The court rejected the request for urgent legal protection and gave the residents, including children, only a few weeks to find a new place to live. “We are sitting on packed suitcases,” explains Benjamin Büchling, a member of the club. Kerstin Scholle, also a resident, is looking for temporary solutions for herself and her children.
Legal situation and alternative housing
The reasons for the ban on use lie in a years-long legal dispute over a failed building permit for the car park, which is located outside. Carsten Huhn, a member of the association and property owner, criticizes the decision, which he finds disrespectful. In December 2023, he filed a lawsuit against the failed building permit, the outcome of which is currently still open. In the court's opinion, the public interest in a ban on use outweighs the private interest in use.
Use without permission, as is the case in this case, is a common reason for usage bans, which can be issued by authorities or private individuals. This not only affects the right of residence of those affected, but also brings economic uncertainty. Huhn now has three months to vacate his property, otherwise he faces a fine of 3,000 euros.
Despite the criticism of the Kassel building authority and the hindrance to the search for legal alternatives, Huhn is still undecided as to whether he will appeal against the court decision. But a short-term forced eviction is not expected at the moment, as the city of Kassel plans to discuss how to proceed internally.
