On October 14, 2025, a 24-year-old man from Diepholz was sentenced to six years and six months in prison in the Aurich regional court. This verdict was made due to serious offenses, including particularly serious extortion, robbery and grievous bodily harm NWZonline reported. The man's actions took place some time ago. On July 29, 2023, he and accomplices attacked a tenant in Leer and his friend. Both victims were attacked with pepper spray and threatened with a knife. During this robbery, the perpetrators stole valuables worth 2,000 euros, jewelry and smartphones. The incident became particularly dramatic when the tenant faked an epileptic seizure in order to drive away the attackers. He was already suffering from mental health problems and needed therapeutic help after the incident.
Burden of proof and conviction
The evidence that led to the defendant's conviction included a handprint at the crime scene and his previous conviction, which goes back to a similar crime. According to the prosecutor and a psychiatric expert, the defendant's statement that he could not remember the crime because of his cannabis consumption was not credible. Witnesses also reported no signs of failure during the crime, which is why reduced culpability was not recognized. While the defense pleaded for acquittal because there was no clear identification of the defendant by the witnesses, the court viewed the handprint as clear evidence of his perpetrator.
