In a current case, a weather service has already been convicted by the Cologne Higher Regional Court because of a defective cookie banner. This makes it clear that data protection is not only of great importance in theory, but also in practice. Responsibility for enforcing the TDDDG lies with the data protection supervisory authorities of the federal states, which can lead to regional differences in handling.
These regulations don't happen without reason: there have been regulations since 2009 that restrict the use of information stored in the device. The ePrivacy Directive has also played a central role in the data protection discourse for decades. The TDDDG and other laws, such as the AI Regulation, create a comprehensive legal network that aims to protect user privacy while promoting digital services.
