Important information event for Lübeck legal advisors on October 27th!

On Monday, October 27, 2025, the Association for Care and Self-Determination in Lübeck e. V. invites all Lübeck citizens who have been appointed by the district court as legal guardians for their relatives to an important information event. This will take place from 5:30 p.m. in the DRK sisterhood at Marlistraße 10. Here the participants should have the opportunity to exchange ideas about their tasks as legal guardians and to receive new information.

Background to the Care Act

The Care Act, which came into force in 1992 as a “reform of the century”, has set itself the task of strengthening the rights of sick or disabled people. The aim was to abolish incapacitation and paternalism and instead to focus on individual legal representation and self-determination. At least since the reform on January 1, 2023, the right to self-determination has been a particular focus. While previously the focus was primarily on the well-being of the people being cared for and the actions of the carers, the wishes and needs of the people being cared for are now becoming the focus, which poses new challenges for the legal carers.

How BTV-HL reports, the role of volunteers is becoming increasingly important, because in the future they will have to be guided by new guidelines, which also include regular training and advice. It is important that carers present a police clearance certificate and an extract from the debtor register to prove their suitability.

Independent living and support

The new reform of the care law, as well as through Human Action presented, scores points with the approach that the wishes of the people being cared for are given greater consideration. Carers should always keep the presumed will of the person being cared for in mind and substitute decisions should remain the exception. Before the care begins, it is also determined in which areas support is actually needed. This new development sharpens the perception of the role of carers and strengthens the voice of the people being cared for.

Another important aspect of the reform is that coercive measures, such as forced sterilization, are now inadmissible if the person being cared for is unable to express their own wishes. This shows a clear trend towards more self-determination and the inclusion of the people being cared for in all relevant decisions. In the future, court and official letters will no longer just have to go to the carers, but also to the people being cared for themselves, which significantly strengthens their right to have a say and participation.
