Bicycle thief in Offenburg: caught drunk on the second attempt!

A 30-year-old man is targeted by the police, twice over. On Wednesday he was found attempting to steal a bicycle twice in Offenburg. First at 11:30 a.m. at Schillerplatz when he wanted to steal a parked bicycle. However, thanks to the quick reaction of a patrol crew, the stolen bike was recovered and the suspected thief was checked.

But that's not all: early in the evening our “hero” was observed again on Rammersweierstrasse, where he tried with all his might to pick a bicycle lock. The emergency services were there again and were able to temporarily arrest him. During the check, an alcohol content of around 1.5 per mille was found, which put him in a legally precarious position.

Drinking and driving is also an issue when cycling

The alcohol limit for cyclists is clearly regulated. From 1.6 per mille you are considered absolutely unfit to drive and are liable to prosecution. Even at 0.3 per mille, conspicuous driving habits such as snaking or falling can lead to a criminal complaint [[adac.de]](https://www.adac.de/verkehr/recht/verkehrsgesetze-deutschland/promillelimit-fahrrad/). A cyclist must be aware that depending on their alcohol level and driving behavior, they could face serious consequences.

From a value of 1.6 per mille, you can expect not only a fine of around one month's salary, but also the ordering of a medical-psychological examination (MPU), even if you do not have a driving license. This means that the authorities could prohibit cycling in the future until further notice if there is a risk from future alcohol consumption [[anwalt.org]](https://www.anwalt.org/lokal-fahrrad/).

Penalties for cyclists

The effects of a penalty for drunk cyclists are quite drastic. From 1.6 per mille you not only face a fine and MPU, but also the entry of two points in the fitness to drive register in Flensburg. A harsh judgment that shows: Anyone who is behind the handlebars of a bike and has drunk too much would do well to pay attention to responsible behavior.

While pedestrians who push a bike are not necessarily prosecuted as long as they do not show any signs of failure, the situation is completely different for cyclists who drink alcohol. Our current reporting is not only intended to draw attention to the legal situation, but also to serve as a reminder: alcohol and cycling - these are two things that don't go together!

In the end, it remains to be hoped that the 30-year-old man from Offenburg will see his misconduct as a learning experience and will refrain from criminal activities in the future in order not to endanger his own well-being and that of those around him.
