In Sigmaringen, a 47-year-old had to face the consequences for her infidelity as cashier of a fool's club. She was convicted after withdrawing money from the club's account over a period of several years. According to a report by Schwäbische.de The damage caused amounts to around 28,700 euros, spread over a total of 48 withdrawals between 50 and 800 euros.

The case was only discovered when a new board team was elected. During the investigation, the woman confessed that she had withdrawn the money for family reasons. She even admitted in a WhatsApp group that she had helped herself to the funds. The manipulation of financial audits is also one of the allegations made against them.

Legal situation surrounding infidelity

But what exactly does infidelity mean? According to Section 266 of the Criminal Code, breach of trust occurs when a person abuses their authority and thus damages other people's assets. This is particularly true for members of association boards who are responsible for managing the association's assets. The IWW declares that the obligation to look after the assets begins when the board is in office and ends when he is removed. What is important is that infidelity is committed intentionally or at least partially intentionally, which means that simple negligence is not enough.

In the case of embezzlement, which results from improper use of club assets, a treasurer could, for example, use money for private purposes - a clearly punishable offense. The criteria for the comprehensible definition of infidelity and embezzlement are provided by bmj.gv.at explained in detail and made it clear that the use of earmarked donations other than intended can also be viewed as breach of trust if this results in financial loss.

Penalty and consequences

The public prosecutor demanded a sentence of one year and ten months, but this was suspended. In addition, 80 hours of community service was ordered. Despite the angry accusation of infidelity, the defendant appeared remorseful and offered to pay back the withdrawn money in installments, which the judge certainly took into account in her decision. The monthly repayment of at least 200 euros to the fool's association was also ordered.

However, it remains uncertain whether the association will take civil action against the defendant. This also depends on how the members of the association deal with this situation and whether they want to make up for the financial damage through legal means.

These events shed light on the important duties of a board of directors and the responsibility that every association leadership bears. It is obvious that protecting club assets is essential to the integrity of the organization.
